Virtual Photo Walk App Terms of Use

These Terms of Use (the “Terms”) set forth the conditions governing the use of the Virtual Photo Walk app and related services (collectively, the “Service”) provided by Virtual Photo Walk (the “Organization”).Virtual Photo Walk welcomes people in a wide variety of circumstances, including those participating from hospitals, care facilities, their homes, and other locations.To ensure that everyone can safely and comfortably enjoy traveling and interacting with others, all users of the Service are asked to comply with the following rules.
Article 1 — Purpose
Through Virtual Photo Walk activities, including live walks, the Service aims to give participants—particularly those who find it difficult to go out—opportunities to enjoy travel, scenery, and connections with others.
Article 2 — User Registration
1.Registration through the prescribed procedure is required to use certain features of the Service.
2.When registering, users must provide the information specified by the Organization, such as a nickname, email address, and municipality of residence.
3.Users must register an email address at which they can personally receive messages.
4.To ensure the safe operation of the Service, the Organization may verify users’ email addresses or conduct other necessary authentication procedures.
5.Users must not register using false information, impersonate another person, or register by any other improper means.
Article 3 — Participation in Live Events
1.Participation in Virtual Photo Walk live events may be limited to users who have been authenticated or approved by the Organization.
2.The ability to install or access the app does not automatically entitle a user to participate in every live event.
3.Users must not provide, forward, disclose, or post on social media or elsewhere any URL, meeting ID, passcode, or other information required to participate in a live event.
4.Information required to participate in a live event may be used only by the registered user to whom it was issued.
Article 4 — Protection of Participants’ Privacy
Virtual Photo Walk places great importance on protecting participants’ privacy.Users must not disclose to any third party, or publish online or on social media, any information about another participant learned through a live event or other interaction without that person’s permission.Particular care must be taken when handling names, faces, voices, the names of hospitals or facilities, places of residence, health conditions, and any other information that could identify an individual.
Article 5 — Video Recording, Audio Recording, Photography, and Similar Activities
Without the permission of the Organization or the individuals concerned, users must not engage in any of the following activities involving live-event screens or participants:•Taking screenshots•Recording the screen•Recording audio•Taking photographs•Saving video, images, or audio•Reposting, streaming, or otherwise distributing such content on social media, video-sharing platforms, or elsewhere onlineIf the Organization records or photographs a live event for documentation, publicity, or similar purposes, participants will be notified in advance when necessary.
Article 6 — Prohibited Conduct
Users must not engage in any of the following conduct when using the Service:
1.Defaming, harassing, threatening, or otherwise causing distress or inconvenience to another participant
2.Engaging in discriminatory, violent, sexual, or other conduct that causes participants anxiety or discomfort
3.Collecting, retaining, or disclosing another participant’s personal information without that person’s permission
4.Participating while impersonating another person
5.Providing or disclosing to a third party information required to join Zoom or any similar platform
6.Gaining unauthorized access to the Service or interfering with its security
7.Intentionally disrupting the operation of the Service
8.Soliciting, advertising, or conducting business for commercial purposes
9.Engaging in religious or political solicitation, or any other solicitation unrelated to the purpose of the Service
10.Violating any applicable law, regulation, or public order and morals
11.Engaging in any other conduct that the Organization determines may interfere with the safe operation of the Service
Article 7 — Suspension of Use and Restrictions on Participation
If a user violates these Terms, or if the Organization reasonably determines that the user may compromise the safety or privacy of other participants, the Organization may, without prior notice, remove the user from a live event, restrict the user’s participation in live events, suspend the user’s use of the Service, or take other appropriate measures.In particular, the Organization may immediately suspend a user’s access in the event of a serious violation, including an infringement of a participant’s privacy, unauthorized recording or photography, disclosure of participation information to a third party, or unauthorized access.
Article 8 — Management of Registration
InformationUsers must properly manage their registration information, including the email addresses used for authentication.If unauthorized use by a third party is suspected, users must promptly contact the Organization.
Article 9 — Handling of Personal Information
The Organization will appropriately handle personal information obtained from users through the Service in accordance with its separately established Privacy Policy.Users should review the Privacy Policy before using the Service.
Article 10 — Changes to or Suspension of the Service
The Organization may modify, cancel, or suspend all or part of a live event or the Service due to communication or system failures, disruptions affecting Zoom or other external services, weather conditions, disasters, local circumstances, or other unavoidable reasons.
Article 11 — Disclaimer
The Organization will endeavor to provide the Service safely and reliably. However, except where a disruption is caused by the Organization’s willful misconduct or gross negligence, the Organization will not be liable for disruptions arising from internet communications, a user’s network environment or device, Zoom, or any other service provided by a third party.Nothing in these Terms is intended to improperly exclude or limit any liability imposed on the Organization by applicable law.
Article 12 — Amendments to These Terms
The Organization may amend these Terms as necessary in response to changes in applicable laws and regulations, changes to the Service, safety measures, or other circumstances.Users will be notified of any material amendments through the app, the Organization’s website, or another appropriate channel.
Article 13 — Governing Law and Good-Faith Consultation
These Terms are governed by the laws of JapanIf any issue arises in connection with the use of the Service, the user and the Organization will consult with each other in good faith and endeavor to resolve the matter.
